those words with an announcement that it will seek a fine against toyota of $16 million for failing to notify officials . starting as off is dave shepardson of "detroit news." many people saw the headline -- regulators seeking a fine of $16.40 million against toyota. the statement said "if upheld." why does it say that? >> toyota gets to formally denied decide whether it wants to appeal the fine. this is by far the largest ever find that nhtsa has sought to impose. the previous was $1 million against general motors in 2004. the amounts are symbolic, given that these are companies with hundreds of billions of dollars in revenue. $16 million is a rounding error for them. >> what happens next? have you heard from toyota? if it goes to court, how long would the process take? >> toyota has two weeks to respond and say they will pay the fine or challenge it. nhtsa has to decide if it is going to uphold the fine. if toyota continues to challenge it, they will go to the district court to get a job to uphold it. that process could take several months if toyota decides to fight it. >> the tra

to the fine that nhtsa is seeking against toyota -- $16.40 million? >> if the evidence points to the fact that toyota was withholding information from regulators and the public it is appropriate. that fine level is relatively new. it is a new authority from the tread act that was passed in response to the ford at firestone issue -- the ford firestone issue. before that, the fine was down in the hundreds of thousands. we were the first ones to cross that million dollar barrel. ford was slow to report a windshield wiper defect that was a safety threat. going to $16 million, to the full extent of the law, sends a message to the industry that they are serious. >> i read one critics saying that "toyota embarrassed the agency and that is where this is coming from." what do you think? >> the agency's mission oriented. it does not have all of the tools it might need. it is usually outgunned by the global industry. this was critic for a national industry. we transitioned to a global industry. it is trying to maintain the rules. what you do is you find people who have gone over the rules and you ho

a decade since they evaluated any vehicle this poorly. yet another black eye for toyota. >> that's right. >> it, of course, is the parent company. >> this is a rare and very direct warning for buyers and owners of the lexus gx 460. about 5,000 cars have been sold. consumer reports says do not buy this car. they found significant and severe rollover risk during turns. they do all of these controlled testings, four different drivers found the same problem. they got another vehicle, found the same problem on this one. they say it is not isolated. it is a problem with the electronic stability control system. it manages the brakes and the steering together. so if you're going up an off ramp and there is some sort of an obstacle, you turn quickly, there could be a real rollover risk for people with this car. if you have this car, they say be very careful on any on ramps or off ramps because they're very concerned about the stability of the vehicle in those circumstances. take it to your toyota dealer and demand a fix. if you don't own this car and thinking about it, consumer reports in a very

of speed, crossed over the double yellow line on alabama and hit that toyota sedan that was full of kids, full of children. just a short time ago we learned the driver of that sedan died. he had four children in his car. two adults were inside the van and police officers arrived on the scene very quickly, managed to help get the driver of the van out because the van was leaking fuel and caught fire. wilts help -- witnesses helped too and described the van as driving dangerously fast. >> i was coming down and the traffic was slowing up right here. i looked in my remember view -- rear view mirror and this van was coming. seemed to me he was going a hundred miles an hour. he hit the car right there and that was pretty much everything. >> reporter: again officers arrived on the scene very quickly and here's why. there was a photo enforcement officer right here on the corner clocking people as they came down alabama. the van never made it quite that far. here's one of the concerns neighbors had. you can see this light right here. there's one just a block up. they operate at the same time. gre

in from the associatedded press and news core, our wire service. toyota is about to get slapped with a big fine. toyota motors is accused by the transportation secretary ray lahood of knowingly hiding a dangerous defect for months, not taking action to protect the public and the united states government is seeking a fine against toyota for 16 -- let's see, $16.4 million. the accusation is that toyota hid this sticking pedal defect. they knew about it and hid it for months and as a result they should pay a fine. this is from the transportation secretary ray lahood. we've spoke spoken to our and drew napolitano and he says this is a small fine considering the damage caused. 2.3 million vehicles recalled and accusation people decide as a result but nothing has been found yet. the judge says they should pay it right away because it's a small fine and if they don't, the united states government will sue them to demand they pay $16.4 million, toyota motor company to the united states government as fine for not telling folks about the sticky pedals. >> the butler bulldogs in indiana tips off agai
